CALIFORNIA PRIVACY RIGHTS

This section provides additional information to California residents about how we process your personal information under the California Consumer Privacy Act of 2018 (CCPA) as amended by the California Privacy Rights Act (CPRA).

Categories of Personal Information We Collect

In the past 12 months, we have collected the following categories of personal information:

  • Identifiers such as name, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, or other similar identifiers.
  • Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)) such as name, address, telephone number, education, employment, employment history.
  • Internet or other similar network activity such as browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement.
  • Geolocation data such as physical location or movements.
  • Professional or employment-related information such as current or past job history.

How We Collect California Residents’ Personal Information

We collect the personal information listed above from the following sources:

  • Directly from you when you provide it to us through our website, email communications, or other interactions
  • Automatically as you navigate through our website (using cookies and other tracking technologies)
  • From third parties that interact with us in connection with the services we perform

How We Use and Share California Residents’ Personal Information

We use and disclose the personal information we collect for the business purposes described in the “How We Use Your Information” and “Sharing Your Information” sections of our Privacy Policy.

Sales and “Sharing” of Personal Information

In the preceding twelve (12) months, NAVI has not sold any personal information, nor has it “shared” personal information (as defined under the CPRA) for cross-context behavioral advertising purposes.

Your Rights Under California Law

The CCPA/CPRA provides California residents with specific rights regarding their personal information. This section describes your rights and explains how to exercise those rights.

Right to Know and Access

You have the right to request that we disclose certain information to you about our collection, use, disclosure, and sale of your personal information over the past 12 months, including:

  • The categories of personal information we collected about you
  • The categories of sources for the personal information we collected about you
  • Our business or commercial purpose for collecting that personal information
  • The categories of third parties with whom we share that personal information
  • The specific pieces of personal information we collected about you

Right to Delete

You have the right to request that we delete any of your personal information that we have collected from you and retained, subject to certain exceptions.

Right to Correct

You have the right to request that we correct inaccurate personal information that we maintain about you.

Right to Limit Use and Disclosure of Sensitive Personal Information

If we collect sensitive personal information, you have the right to limit our use and disclosure of such information to only what is necessary to perform the services or provide the goods.

Right to Opt-Out of Sale or Sharing of Personal Information

You have the right to opt-out of the sale of your personal information or the sharing of your personal information for cross-context behavioral advertising purposes. However, we do not currently sell personal information or share it for cross-context behavioral advertising.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services
  • Charge you different prices or rates for goods or services
  • Provide you a different level or quality of goods or services
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services

Exercising Your California Privacy Rights

To exercise the rights described above, please submit a verifiable consumer request to us by:

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Shine the Light Law

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

Notice to Minors Under Age 18

If you are a California resident under the age of 18, and a registered user of our services, California Business and Professions Code Section 22581 permits you to request and obtain removal of content that you have publicly posted. To make such a request, please send an email with a detailed description of the specific content to info@navivalues.org. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information that you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.
